EIGHTH ANEM MONITORING PUBLICATION

 

 

 

 

The eighth issue of the specialized ANEM Publication "Legal Monitoring of the Serbian Media Scene

 

 

 

For the eighth time in the last four years, the period ANEM with its legal team has been conducting legal monitoring of the Serbian media scene, ANEM has provided the opportunity for the interested public to learn more about pertinent issues related to the media situation in the country, through quality expert texts in its Monitoring Publication.

The Contents of the EIGHTH Monitoring Publication is as follows:

  • Introduction (with summarized results of legal monitoring of the Serbian media scene in the first six months of 2013 and short overview of the Publication contents),

four expert texts:  

  • Why is there still no Media Reform in Serbia - author: Kruna Savovic, Attorney at Law (how long does the media reform last in Serbia and what are the reasons for its failure);
  • State Aid Control and Media Reforms in Serbia - author: Slobodan Kremenjak, Attorney at Law (participation and influence of state aid in the media sector; what has Serbia committed to under the Stabilization and Accession Agreement; what is state aid; in which cases it is allowed, and in which cases it may be allowed;  why state aid to media may be permitted; how the Media Strategy regulates a system of allocation of state aid to media; what is necessary for functioning of that system and why is that important);  
  • Freedom of Expression - author: Saša Janković, Protector of Citizens of Republic of Serbia (how the Constitution of the Republic of Serbia and international law define freedom of expression; what is the substance of freedom of expression; what are its elements; requisits for restriction of this freedom);
  • Media Literacy as a Social Strategy - author: Boban Tomić, PhD (what is media literacy and why is it important for development of society; why both media and the public need to be media literate; media education as a precondition for existance of a media literate society);

and the fifth text,

  • European Court of Human Rights, Information Notes on the Court's case - law (excerpts from the Information Notes, available on the website of this Court) - brief overview of two judgments of this court that are related to article 10 of the European Convention for the Protection of Human Rights and Fundamental Freedoms: the first one addresses infringement of the freedom to impart information by criminal conviction for making public irregular telephone tapping procedures, and the second, violation of the freedom of expression by interim court order incidentally blocking access to host and third-party websites in addition to the website concerned by proceedings
